Traditional legal approaches assume law is unbiased and objective, focusing on legal rules’ coherence, consistency, and predictability. Feminist legal theory, as articulated by Bartlett (1990), challenges this view, questioning the impact of masculine perspectives on legal concepts and norms. As a social construct, law has historically perpetuated power dynamics, including gender inequality, before women’s active participation in legal roles. Feminist legal theory, while acknowledging law's attempts to address women's issues, critiques its failure to fully consider women's experiences and perspectives. To promote social justice and gender equality, feminist legal theory has been increasingly applied to various legal fields, from rape and sexual work to labor, tort, contract, property and company law.
